37 DESIGNATED
PUBLIC PLACES ORDERS
On 1st November 2006, Council
approved the procedural framework for making Designated Public
Places Orders. The Police subsequently requested a wider ban than
the specific areas initially identified, and at its meeting held on
31st May 2007, the Board recommended that Council
consider the evidence presented and the extent of any Designation
Orders.
At Council on 13th June 2007, it
was resolved that the power to make Designated Public Places Orders
under the Criminal Justice and Police Act 2001 be delegated to the
full Licensing and Regulatory Committee for 19 wards in the
Borough. The Committee was further authorised, where
necessary, to extend the boundaries beyond the strict ward
boundaries to create logical boundaries for enforcement
purposes.
The 19 wards identified were –

Members considered the report of the Chief
Executive which set out the key issues and invited the
Committee to approve the making of the Orders, subject to
consultation. The report provided two cost options for
consideration by the Committee.
Option A
Consultation (including letters to each
licensee), street signs, statutory notices, additional larger signs
for open spaces, and signs for display in licensed premises:
£55,668.
Option B
Consultation including letters to licensees,
street signs and statutory notices to meet the minimum statutory
requirements: £38,718.
It was noted that both options had been based on
an assumption that Cheshire County Council would co-operate and
agree to waive its costs of approximately £12,500 for erecting
signage and street furniture.
RESOLVED:
(a) That approval be granted to the making
of the Designated Public Places Order to cover the urban areas
identified in the map appended to the report;
(b) That approval be given to the overlap of
the ward boundary at Wybunbury/Stapeley;
(c) That cost Option B identified in the
report be approved; and
(d) That the Borough Solicitor, in
consultation with the Safer Communities Manager, be authorised to
approve appropriate geographical boundaries for the purposes of
undertaking the statutory consultation exercise.
