DECLARATIONS OF INTEREST

10        Councillors Charlesworth, Dodd, Dykes and J Jones declared a personal interest in item 3 (P07/0476) as the applicant was a Conservative party colleague.  Councillor Richardson stated that the grounds for his personal interest in item 3 (P07/0476) was that the applicant was a fellow Ward Councillor for Audlem.  Councillor Hollins declared a personal and prejudicial interest in the same item (P07/0476) as the application was a personal friend. 

Councillor Goff stated that although he had declared a personal and prejudicial interest in item 3 (P07/0476) at the previous meeting and had left the room during consideration of the application; he had subsequently sought legal advice and now considered that he had a personal interest only which he then declared.              

Councillor Hollins declared a personal and prejudicial interest in items 11 (P07/0621) and 12 (P07/0625) as she was a friend of the applicants; Councillor Richardson declared a personal interest only in the same applications as he considered himself to be an acquaintance of the applicants.

Notwithstanding the additional plans showing a proposed slab level of 36.45 mAOD and the response from the Environment Agency, the site of the proposed development is located within the Flood Risk Zone about 30m from the River Weaver.  In this location it is considered that the development would be inappropriately sited and at risk from flooding.  To allow the development would thus be contrary to Policy NE.20 (Flood Prevention) of the Borough of Crewe and Nantwich Replacement Local Plan 2011 and advice contained in PPS25: Development and Flood Risk.

2          In the opinion of the Local Planning Authority the design of the proposed extension does not respect the scale, character and form of the existing building and its surroundings and would adversely affect the street scene by reason of its design, scale, height and proportions.  The development is therefore contrary to Policy BE.2 (Design Standards) of the Borough of Crewe and Nantwich Replacement Local Plan 2011.

3          In the opinion of the Local Planning Authority, the proposed development by reason of its scale and siting would result in an unacceptable adverse effect on the residential amenity afforded to No. 42 Wellington Road as a result of overlooking, overshadowing and disturbance from vehicles contrary to Policy BE.1 (Amenity) of the Borough of Crewe and Nantwich Replacement Local Plan 2011.

4          In the opinion of the Local Planning Authority, the loss of the existing schoolhouse building to the rear of the site would detract from the character and appearance of the site and the quality of the built environment in the locality generally, contrary to Policy BE.2 (Design Standards) of the Borough of Crewe and Nantwich Replacement Local Plan 2011. 

5          A Noise Impact Assessment has not been submitted with the application and as a result, it is considered that the applicants have failed to demonstrate that the main road adjacent to the site would not have an unacceptable impact on proposed development which, being residential in nature is sensitive to noise.  This is contrary to Policy NE.17 (Pollution Control) of the Borough of Crewe and Nantwich Replacement Local Plan 2011.

CONSERVATION AREA APPRAISALS

13        In July 2005, the Development Control Committee appointed a Conservation Areas Sub-Committee to undertake a programme of works to update and review 13 appraisal reports and consider 6 new appraisals; the Sub Committee being reappointed each year.

The report of the Conservation Officer outlined the work undertaken by the Sub Committee during 2006/2007 in relation to Acton, Higher Bunbury, Lower Bunbury, Barthomley, Church Minshull, Englesea Brook, Marbury, Peckforton and Weston Conservation appraisals and set out a number of recommendations which the Committee was invited to approve. 

RESOLVED: That;

a)        The Conservation Area Character Appraisal documents for Acton, Higher Bunbury, Lower Bunbury, Barthomley, Church Minshull, Englesea Brook, Marbury, Peckforton and Weston, as amended, be approved; the proposals in each appraisal to be actioned by officers as management strategies;

b)         A Notice be placed in the local press and the London Gazette advertising any approved amendments to the boundaries of the conservation areas and the sending of a letter to the owners of these properties or areas of land notifying them of this and the consequences;

 

c)         The approved amendments to the boundaries of the conservation areas be registered as a local land charge; and

 

d)         all who responded to the consultation be sent a letter thanking them for their participation and advising them of the changes made.                             

APPOINTMENT OF THE CONSERVATION AREAS SUB-COMMITTEE   

14        To undertake the programme of conservation area appraisals scheduled for 2007/2008 (namely Aston, Audlem, Crewe Green and Warmingham), the Committee was invited to reappoint the Conservation Areas Sub Committee.

Five nominations were sought from the Committee on a politically proportionate basis.  Members noted that those Councillors who represented the wards under review would be co-opted onto the Sub Committee as non-voting members.

15        The Committee considered the report of the Borough Planning Officer which suggested the name “Rope Hall Lane” for an unnamed road situated between Rope Lane and Eastern Road, Shavington; the proposal having been submitted by Rope Parish Council.

RESOLVED: That the name “Rope Hall Lane” be accepted for inclusion in the Local Land and Property Gazetteer.
