DECLARATIONS OF INTEREST


74        Councillor Davies declared a personal and prejudicial interest in item 5 (P07/1432) on the grounds that he had objected to the application.  Councillor Dykes had also been named in a local paper as an objector to the same application but stated that this was incorrect; he had not voiced an opinion on the matter and therefore no interest needed to be declared.      

Councillor Jones declared a personal and prejudicial interest in item 12 (P07/1612), item 15 (P07/1675) and item 17 (P07/1721) as he had had business dealings with each of the applicants. 

Councillor Dykes declared a personal interest in item 14 (P07/1654) as a member of Wulvern Housing’s Board.

Although not a member of the Committee, Councillor Hammond declared a personal interest in item 15 as a member of Haslington Parish Council.

APPLICATIONS UNDER THE TOWN AND COUNTRY PLANNING ACT 1990

76        The Borough Planning Officer submitted the following applications for determination.

 

1.         P07/1071       Outline Application for Warehousing and Distribution

1.      Consideration of any new issues relating to the effect of the development on the right of way, raised in the representations, following the expiry of the consultation period in relation to the advertisement of the development as affecting the right of way;

2.      The signing of a Section 106 Agreement in relation to the following matters;     

 

            HIGHWAYS MATTERS

 

a)      Prior to first occupation, the developer shall complete works at Junction 16 of M6 and its A500 eastern approach by the provision of an extra lane (not less than 3.65m wide) in accordance with Capita Symonds drawing number 56814/SK/03 rev P2 and Cheshire County Council drawing PC/12043/04/01 D/A, or any plan combining these two drawings. Full  details of the works to be submitted and approved in accordance with Section 278 Agreement.         

 

b)      Commuted payment for £3.2 million (index linked to construction prices) as a contribution towards the construction of Crewe Green Link Road South. The payment shall be made prior to letting of the contract for the road.     

 

c)      Commuted payment for public transport £300,000 as five equal phased payments, first payment to be made prior to the commencement of  development and index linked.  The payment shall be used within ten years.    

           

d)       Commuted payment of £200,000 for traffic management, index linked, to be made at commencement of development :-

- traffic management to prevent ‘rat running’ in villages of Englesea Brook, Weston, Basford, Barthomley and Shavington; also Nantwich Road, Crewe and residential areas of Crewe in Alexandra Ward;             

- Traffic Regulation Order, controlled parking zones etc

- Including reasonable fees and administration for Cheshire County Council. 

 

e)     Works to be completed by the developer or by Cheshire County Council following a commuted payment:- 

- improved footpath/cycle links Clough Walk to Gresty Green Road, under railway

- improved footpath/cycle links from Claughton Avenue to Davenport Avenue via Smallbrook Walk

- Cycle routes along Crewe Road, Shavington

- Provision of pedestrian cycle links to Crewe Road, Shavington

f) Travel Plan Co-ordinator and submission of interim Umbrella Travel Plan prior to commencement of development. Establishment of Travel Plan Management Organisation and Basford Transport Steering Group. Travel Plan to include triggers and at 861 vehicles no further development.      

 

g)  Submission of final Subsidiary Travel Plan for all reserved matter units within 3 months of the date of first occupation of each unit.  Interim Umbrella Travel Plan to include model subsidiary Travel Plan.  Updating of Interim or Final Umbrella Travel Plan (as appropriate) annually or as may be agreed.    

 

RAIL ISSUES

   

h)  The provision of rail links from the main line to the application site to be provided prior to the development of rail linked units (Phase 3).  Trigger at 4,645 sq m B1 development, 18,580 sq m B2/B8 development and 47,844 sq m B8 development.  

 

WILDLIFE/LANDSCAPE MATTERS

 

i)  Define areas of landscaping and wildlife mitigation, including land behind The Cheshire Cheese, land east of Greenbank Farm, rear of Crewe Road, Shavington and along southern boundary as well as areas to the north, north east and south east of the development.  Mitigation areas to be phased.   

   

j)  Submission of a southern boundary scheme to include screen planting, wildlife measures as well as ponds (phase 1 of the development).    

 

k)  Provide an ecological framework for the whole site which identifies priority biodiversity resource areas which have potential for returning these resources to viable wildlife levels and wildlife corridors, including

- the creation of new ponds and enhancement of existing ones

- hedgerow restoration and commuted payment for off-site tree and hedgerow planting

- conservation management scheme for local water courses

- provision of wildlife tunnels under roads

 

l) Mitigation schemes for protected species; Badgers, Great Crested Newts, bats and bird boxes

 

m) Timetable for phasing of the ecological works

The Local Planning Authority considers that the proposed garage, by reason of its prominent position in the streetscene, forward of the existing building line, will appear as an alien and intrusive feature all to the  detriment of the character and appearance of the area. As such, the proposal is contrary to Policy BE.2 (Design Standards) of the Borough of Crewe and Nantwich Replacement Local Plan 2011.

REFUSED:     Reason     

           

The Local Planning Authority considers that the proposed development by reason of its siting and height of 60m would be visually intrusive in this rural area and would therefore be harmful to the character and appearance of the adjacent Areas of Special County Value.  As such the proposal would be contrary to Policies NE.2 (Open Countryside), NE.3 (Areas of Special County Value) and NE.19 (Renewable Energy) of the Borough of Crewe and Nantwich Replacement Local Plan 2011.

The Local Planning Authority having regard to all relevant facts, representations and information submitted in respect of this application considers that the application site forms an important natural buffer between the residential properties at 1-4 Green Lane and the existing industrial/storage premises.  It therefore considers that the development would result in an unjustified incursion into open countryside and that there is insufficient justification in terms of the requirement to site the proposed office building on this existing Greenfield site.  The development will therefore conflict with Policy NE.2 (Open Countryside) of the Borough of Crewe and Nantwich Replacement Local Plan 2011.

REFUSED:     Reasons  

 

1          In the opinion of the Local Planning Authority, the applicant has failed to demonstrate both a quantitative and a qualitative need for the proposed development.  In quantitative terms, existing commitments are likely to absorb capacity until 2013. In qualitative terms, the lack of clarity over the end user of the unit makes it difficult to consider how the proposal could address any qualitative deficiency.  It is also considered that the application proposal fails the sequential approach.  It would therefore be contrary to the provisions of Policy S10 of the Borough of Crewe and Nantwich Replacement Local Plan 2011 and the provisions of PPS6.

 

2          In the opinion of the Local Planning Authority the proposed development fails to achieve a high standard of design and layout which enhances the built environment and creates an area of identifiable character, enhancing public views and vistas. It is therefore contrary to Policy BE.2 (Design Standards) S10 of the Borough of Crewe and Nantwich Replacement Local Plan 2011 and the provisions of PPS1.         

 

10.       P07/1593       Creation of an Additional 2230 sq m of Retail Floorspace   

At Mezzanine Level, Unit 15 Grand Junction Retail Park, Crewe for USB Global Asset Management (UK) Ltd                        

 

         REFUSED:     Reasons 

                       

1          The proposed floorspace generates an additional parking requirement of 112 spaces. In the opinion of the Local Planning Authority there is insufficient space in the immediate vicinity to provide this number of additional spaces and in the absence of any justification for the lack of parking provision, it is concluded that the development would be detrimental to highway safety and therefore fails to accord with BE.3 (Access and Parking) and TRAN.9 (Car Parking Standards) of the Borough of Crewe and Nantwich Replacement Local Plan 2011.     

          

2          In the opinion of the Local Planning Authority the applicant has failed to demonstrate both a quantitative and a qualitative need for the proposed development.  In quantitative terms, existing commitments are likely to absorb capacity until 2013.  In qualitative terms, the lack of clarity over the end user of the unit makes it difficult to consider how the proposal could address any qualitative deficiency.  The retail assessment is lacking an assessment of trade draw and impact and consequently the applicant has failed to demonstrate that the proposal, either by itself or together with other shopping development will not harm the vitality and viability of Crewe town centre, contrary to Policy S10 of the Borough of Crewe and Nantwich Replacement Local Plan 2011 and the provisions of PPS6

TREE PRESERVATION ORDER: LAND SOUTH OF THE BEECHES, AUDLEM ROAD, HATHERTON (ORDER NO. 211) TPO 2007  

 

77        The report of the Borough Solicitor gave details of a provisional Tree Preservation Order (No. 211) made on 5th September 2007 to safeguard a number of trees (Yew, Sycamore, Horse Chestnut and Holly) on an area of land south of The Beeches, Audlem Road, Hatherton, which might be subject to development pressure in the future. 

 

The Committee was invited to confirm the Order without modification.

 

RESOLVED: That the Land South of The Beeches, Audlem Road, Hatherton Tree Preservation Order Number 211 made provisionally on 5th September 2007 be confirmed without modification.               

 

TREE PRESERVATION ORDER: LAND TO THE REAR OF 2 ROWTON ROAD, CREWE (ORDER NO. 212) TPO 2007


78        The report of the Borough Solicitor gave details of a provisional Tree Preservation Order (No. 212) made on 5th September 2007 to safeguard an Oak tree on land to the rear of 2 Rowton Road, Crewe which was considered to make a significant contribution to public amenity in the locality.   

 

The Committee was invited to confirm the Order without modification.

 

RESOLVED:            That the Land to the Rear of 2 Rowton Road, Crewe (Order Number 212) made provisionally on 5th September 2007 be confirmed without modification.     


TREE PRESERVATION ORDER: LAND ADJACENT TO NO. 47 AUDEM ROAD, NANTWICH (ORDER NO. 214) TPO 2007

 

79        The report of the Borough Solicitor gave details of a provisional Tree Preservation Order (No. 214) made on 23rd October 2007 to safeguard a number of Oak and Silver Birch trees situated upon an area of land adjacent to 47 Audlem Road, Nantwich which might be subject to future development pressures. 

 

The Committee was invited to confirm the Order without modification.  

 

RESOLVED:  That the Land adjacent to No. 47 Audlem Road, Nantwich (Order Number 214) made provisionally on 23rd October 2007 be confirmed without modification.             

 

TREE PRESERVATION ORDER: 58 SOUTH CROFTS, NANTWICH (ORDER NO. 216) TPO 2007

 

80        On 23rd November 2007, a provision Tree Preservation Order (No. 216) had been made to safeguard three trees upon an area of land at 58 South Crofts, Nantwich which might be subject to future development pressures. 

 

The trees had initially been identified as Sycamores but it had come to light that they were, in fact Sycamore and Ash trees.  A revised report was tabled at the meeting together with an amended schedule and the Committee was invited to confirm the Order with modification.  

 

RESOLVED:  That the 58 South Crofts, Nantwich (Order Number 216) made provisionally on 23rd November 2007 be confirmed with modification by changing the description of the species of T2 and T3 from Sycamore to Ash as set out in the amended schedule.


APPLICATION FOR THE DIVERSION OF PARTS OF FOOTPATHS AT STAFFORD STREET, CREWE IN THE BOROUGH OF CREWE AND NANTWICH

 

81        An application had been received by Wulvern Housing Limited for the diversion of parts of footpaths (adopted highways reference numbers FY1612, FY1625, FY1626) in the vicinity of 59 Stafford Street, Crewe, which would be affected by a proposed development at the site. 

 

The report of the Borough Solicitor invited the Committee to approve the application.             

 

RESOLVED:  That all necessary steps be taken to secure the diversion of parts of footpaths (adopted highways reference numbers FY1612, FY1625 and FY1626) (including the making of an Order under Section 257 of the Town and Country Planning Act 1990) to enable development to be carried out at 59 Stafford Street, Crewe.   

  


 

STREET NAMING: EDDIVANE COURT, HASLINGTON (LAND OFF CROSS STREET AND TO THE REAR OF 60 CREWE ROAD, HASLINGTON)

 

82        In December, the Committee had been unable to agree on a suitable name for the development situated on land off Cross Street and to the rear of 60 Crewe Road, Haslington, as it was considered that the name proposed ‘Fox Hollow’ would cause confusion with other similar addresses in the borough.  The item was deferred to allow for alternative suggestions to be put forward.     

 

            The report of the Borough Planning Officer stated that Haslington Parish Council had suggested the name ‘Eddivane Court’ after a former Parish Councillor and in the absence of a recommendation from the developer, the Committee was invited to approve the name.  However, it was reported at the meeting that the developer 3Cs Development had come forward with an alternative name of ‘Reynard’s Den’ and the Committee was asked to nominate its preferred choice. 

 

RESOLVED: That the name ‘Eddivane Court’ be accepted for inclusion into the Local Land and Property Gazetteer.

86        The report of the Borough Solicitor sought authority from the Committee to institute appropriate legal proceedings both in general and against a named developer, in connection with a failure to comply with the terms of a legal agreement. 

 

RESOLVED:  That authority be delegated to the Borough Solicitor to institute proceedings, including proceedings for an injunction in order to enforce the provisions of legal agreements made under Section 106 of the Town and Country Planning Act 1990 as amended:-

 

1.                  In connection with the agreements relating to the property described in the report submitted; and

2.                  In connection with any legal agreement where there has been a failure to comply with its terms.
