1 The
proposed new dwellings and conversion of the traditional brick
buildings by reason of the cumulative impact of the number and
scale of alterations including the provision of extensions,
outbuildings, and lean-tos, the addition of roof lights, new door
and window openings to dwellings will result in an unsympathetic
scheme harmful to the character and appearance of the outbuildings
at this Grade II Listed farmhouse. In addition, boundary
treatment around the site is not sympathetic to the rural and
historic setting but presents an excessive degree of enclosure. To
allow the development would be detrimental to the setting of the
farmhouse and contrary to Policies BE.2 (Design) and BE.10 (Changes
of Use for Listed Buildings) of the Borough of Crewe and Nantwich
Replacement Local Plan
2011.

2 The
provision of four new dwellings as affordable dwellings within the
development is not justified by any specific survey to demonstrate
a need for the dwellings. Further the site is not close to
any settlement which offers local services and facilities for
residents at the affordable dwellings and the submission fails to
demonstrate that the units would be affordable to people in need of
the dwellings. The proposal therefore fails to comply with the
regulations of Policy RES.8 of the Borough of Crewe and Nantwich
Replacement Local Plan 2011. To allow the new housing without the
special justification would be contrary to Policies RES.5 and NE.2
of the Borough of Crewe and Nantwich Replacement Local Plan
2011.
3 The
submitted bat and barn owl surveys and mitigation measures
dated May 2005 and July 2007 do not include surveys of the
mid twentieth century building to be demolished. The submitted
information therefore fails to demonstrate that there will be no
adverse effect on protected species using the site. To allow
the development would be contrary to Policy NE.9 (Protected
Species) of the Borough of Crewe and Nantwich Replacement Local
Plan 2011 and guidance in PPS9: Biodiversity and geological
Conservation.

The Local Planning Authority considers that
the proposed extension of opening hours would adversely

extended opening hours would result in no reasonable respite

VALIDATION OF PLANNING APPLICATIONS –
‘LOCAL LIST’ FEEDBACK FROM CONSULTAION EXERCISE

Central Government intended to amend the Town and Country (General
Development Procedure) Order 1995 to introduce mandatory standard
planning application forms and associated information requirements
for validation of applications with effect from 6th
April 2008.
In advance of the amended regulations, the
Development Control Committee, at its meeting held on
10th January 2008, had approved a proposed ‘local list’
of validation requirements for consultation.
The report of the Development Control
Manager, now submitted, up-dated Members on the responses received
during the recent consultation exercise. The Committee was invited
to recommend the ‘local list’ of validation requirements to Council
for approval, together with a recommendation to delegate authority
to the Development Control Manager to permit minor amendments to be
made to the procedure. An addendum to the report was tabled
at the meeting which provided consultation responses with changes
to wording or content.
RECOMMENDATION TO
COUNCIL:
(a)
That the ‘local list’ of validation requirements, as part of the
1APP project be formally adopted; and
(b)
That authority be delegated to the Development Control Manager to
allow minor amendments to be made to the adopted list and to make
amendments which take into account statutory changes or government
guidance, without the need to undertake a full review or
consultation.
STREET NAMING: WELLSGREEN PLACE,
WISTASTON (23 NESSINA GROVE,
WISTASTON)
92 The
Committee considered the report of the Borough Planning Officer
which proposed the name ‘Wellsgreen Place’ for the development
situated at 23 Nessina Grove, Wistaston.
The name had been suggested by the developer,
JS Developments, after the brook which ran adjacent to the site.
Both the Royal Mail and the Parish Council had been consulted
and there were no objections.
RESOLVED: That the name
‘Wellsgreen Place’ be accepted for inclusion in the Local Land and
Property Gazetteer.
LIST OF BUILDINGS OF LOCAL

93 In
1996, the Borough Council approved the creation of a List of
Buildings of Local Interest under Paragraph 6.16 of PPG15: Planning
and Historical Environment 1994 with nominations for inclusion
approved by the Planning Committee.
A nomination had been received from Audlem and
District History Society for inclusion in the list, a water pump
situated in the courtyard to the rear of 16 The Square,
Audlem. The Committee was invited to approve its
inclusion.
RESOLVED: That the
water pump situated in the courtyard to the rear of 16 The Square,
Audlem, which met the approved criteria, be included in the
existing List of Buildings of Local Interest in the Borough of
Crewe and Nantwich Replacement Local Plan
2011.

RECENT MARKETING OF THE NORTH WING OF
COMBERMERE ABBEY
96 The
North Wing of Combermere Abbey, a Grade I listed building, was in
need of repair and restoration. To enable the works to be
carried out, an application for an enabling development had been
submitted to the Development Control Committee in 2004. The
application had been refused and had also been dismissed at
Appeal.
One of the grounds given by the Inquiry
Inspector for dismissing the appeal was that no market-testing had
been conducted by the applicant in respect of either the whole or
part of the estate to ascertain whether a buyer could be found who
would be willing to carry out restoration works. The report of the
Conservation Officer provided details of the outcome of such an
exercise.
Members expressed concern regarding the access
arrangement to the previously proposed site for the enabling
development.
RESOLVED:
That the developers be informed that wherever the
revised enabling development was to be located, and in whatever
form, an alternative means of access should be used, with
preference being given to the gates adjacent to the Abbey.
