A Member stated that application P05/1628 (Demolition of
existing bungalow and garage and erection of replacement dwelling,
28 Cheerbrook Road, Willaston for c/o Knight and Sons Solicitors)
had been refused at the meeting on two grounds: 1) overdomination;
and 2) overlooking. However, only one reason for
refusal had been recorded in the Minutes, that of
overlooking. A correction to the Minutes was
requested to include both
grounds.
RESOLVED: That
subject to the inclusion of the following wording relating to
application P05/1628, the Minutes of the meeting held on
27th July 2006 be approved as a correct record
"The Local Planning Authority having regard to all relevant
facts and representations considers that the bulk and massing of
the proposed dwelling would fail to respect the character and form

to Policy CF.2 (Community Facilities) of the Borough of Crewe and

2. The Local Planning Authority considers
that the proposed development is unacceptable by reason that
vehicles accessing the proposed car park will enter/leave alongside
the adjacent dwelling known as The Vicarage.
This vehicular movement will detrimentally affect the amenity of
the occupiers of that dwelling by reason of noise, disturbance and

Reasons
1. The submitted plans and information
(including the Arboricultural Condition Survey completed by
Bartlett Tree Experts and dated 7th February 2006) fails
to demonstrate that the development can be adequately accommodated
on the site without endangering the long term health and retention
of the trees on site which are the subject of Tree Preservation
Order Number 168. Further, the position of this
building fails to provide sufficient space to allow the trees to
continue to grow without restricting light to windows and could
lead to regular requests to prune the trees. To
allow the development would be contrary to Policy NE.5 (Nature
Conservation) of the Borough of Crewe and Nantwich Replacement
Local Plan
2011.
2. The proposed development by reason of
its bulk, size, mass, design and appearance will result in a
building which does not respect the character and appearance of the
locality and especially the adjacent property known as Mill House,
Crewe Green Road, Crewe and fails to enhance the built
environment. To allow the development would be
contrary to Policies BE.2 (Design) and BE.13 (Buildings of Local
Interest) of the Borough of Crewe and Nantwich Replacement Local
Plan 2011 and government advice in particular paragraphs 33-39 of
PPS.1 Delivering Sustainable Development.
3. The proposed two and a half storey
building by reason of its position, size, height, bulk and mass and
the presence of windows to the second floor lounge and bedrooms 19
and 34 will result in overlooking and will dominate the private
garden area of the property known as 24 Mill Bridge Close,
Crewe. To allow the development would be
contrary to Policy BE.1 (Amenity) of the Borough of Crewe and
Nantwich Replacement Local Plan
2011.

REFUSED: Reason
The Local Planning Authority considers that the proposed
development is unacceptable by reason of its bulk, mass and design
which results from a single overly large building, a lack of
articulation to break up its massing and the general
overdevelopment of the site. The undercroft car
parking will not unite with the building and will result in a
dominance of car parking especially from the front
elevation. The design of the side wings and
front gables and also the main roof element fails to relate to the
rhythm of the elevations. The proposal will
therefore have a detrimental impact upon the character and
appearance of the street scene and is contrary to Policy BE.2
(Design Standards) of the Borough of Crewe and Nantwich Replacement
Local Plan 2011 as well as PPS.1 (Delivering Sustainable
Development).

SITE INSPECTIONS PROTOCOL

Following the adoption of a Site Inspection Protocol by the
Development Control Committee on 1st June 2006, a minor
amendment to the document (changing the day of the site inspections
from Mondays to Fridays) was approved on 27th July
2006.
Although the protocol was not due for review until 6 months
had passed, Members' had expressed concerns about the operation of
the protocol. The report of the Development
Control Manager proposed a number of further amendments to the
protocol in order to address the issues
raised.
During the discussion two further amendments to the protocol
were proposed; the inclusion of a fourth bullet point at b) with
the wording "To enable Members to see plans in the context of the
site"; and additional wording at paragraph d) the effect of which
would be to allow the Development Control Manager to receive and
consider written representations to visit sites adjacent to the
inspection site.
The Committee was invited to consider the changes
proposed.
RESOLVED: That the revised Protocol as
appended to the report submitted and incorporating the amendments
listed above, be approved and adopted as Crewe and Nantwich Borough
Council's Site Inspection Protocol.

The report of the Borough Planning Officer invited the Committee to
approve the name 'Railway View' for the development as proposed by
the developer Property Developments (Crewe) Ltd.
The name had been suggested due to the proximity of the site to the
railway.

Land and Property Gazetteer.
