DECLARATIONS OF INTEREST
 
36        Councillor Dykes declared a personal interest in item 3 (P06/0676) by virtue of his position as a member of Wulvern Housing Board.  Councillor Richardson declared a personal and prejudicial interest in items 7 and 8 (P06/0869 and P06/0870) on the basis that he was the applicant.  Councillor Jones declared a personal interest in item 14 (P06/0941) by virtue of his working relationship with the applicant.

APPLICATIONS UNDER THE TOWN AND COUNTRY PLANNING ACT 1990
 
38        The Borough Planning Officer submitted the following applications for determination.
 
1.         P05/1485       Demolition of 34 & 36 Conway Close and Erection of 20  
Two Storey Dwellings and Associated Access, 34, 36 and Land to Rear Conway Close, Crewe for Glade Homes Ltd          
 
REFUSED:     Reasons  
 
1          The proposed development as a result of the narrow carriageway width along the existing section of Conway Close and traffic generation caused by the additional dwellings would fail to provide satisfactory vehicular access and egress arrangements to the detriment of highway safety.  This would conflict with Policy BE.3 (Access and Parking) of the Borough of Crewe and Nantwich Replacement Local Plan 2011. 
    
2           The proposed development as a result of its proximity to the West Coast main railway line is considered to be incompatible with the surrounding land use and notwithstanding the proposed mitigation measures identified in the accompanying noise assessment the future occupants would suffer a loss of amenity through noise and vibration or would otherwise be forced to keep windows and doors closed and rely on purely passive forms of ventilation only.  This is considered to be unsatisfactory and in conflict with Policy BE.1 (Amenity) of the Borough of Crewe and Nantwich Replacement Local Plan 2011.

2.         P06/0554       Five Dwellings, Nessina Grove, Wistaston for Muller  Property Holdings
 
REFUSED:     Reason  
 
The development would result in vehicular traffic to the proposed dwellings, as well as additional traffic using the drive to gain access to the turning head within the site, passing close to the dwelling known as 21 Nessina Grove, Wistaston.  The comings and goings of these vehicles on the sloping drive and land set above the level of that dwelling would be detrimental to residential amenities at that dwelling.  To allow the development would be contrary to Policy BE.1 (Amenity) of the Borough of Crewe and Nantwich Replacement Local Plan 2011.

REFUSED:     Reason  
 
The operator has failed to prove that there is no other viable alternative location.  The proposal would, by reason of its position close to the carriageway edge and height at 12 meters, fail to assimilate with existing street furniture and would appear unduly prominent from Broadleigh Way and would not be sufficiently screened by the adjacent tree cover.  This would result in material harm upon the visual amenity of the area and would therefore conflict with Policy NE.18 (Telecommunications Development) of the Borough of Crewe and Nantwich Replacement Local Plan 2011 and also PPG.8 (Telecommunications).

10.       P06/0885       Two Dwellings, The Plantation, Whitchurch Road, Aston    
for Mr A J Kynaston        
           
RESOLVED:  That delegated authority be granted to the Borough Planning Officer to REFUSE the application following expiry of the consultation period on the following grounds:       
 
1           The Local Planning Authority considers that the proposed development is unacceptable as the applicant has failed to indicate whether they are willing to enter into a Section 106 Legal Agreement to pay a commuted sum towards the provision of affordable housing in the Borough as required by Policy RES.7.  As such, the proposal is contrary to Policy RES.7 (Affordable Housing within the Settlement Boundaries of Crewe, Nantwich and the Villages listed in Policy Res.4) of the Borough of Crewe and Nantwich Replacement Local Plan 2011.       
 
2          The Local Planning Authority considers that the proposed development is unacceptable by reason of insufficient information relating to the group of Tree Preservation Order trees to the north of the site and other trees within the curtlidge of the site.  The construction and positioning of the dwellings will cause significant damage to these trees and allowing the development could lead to future pressures for the pruning and felling of the trees by any future occupants of the dwellings.  As such, the proposal is contrary to Policy NE.5 (Nature Conservation and Habitats) of the Borough of Crewe and Nantwich Replacement Local Plan 2011.

REFUSED:     Reasons       
 
1          The proposed conversion scheme requires alterations which would be damaging to the traditional character of the building.  These include an excessive number of inappropriately altered openings.  The proposal would, therefore, be detrimental to the character and appearance of the building and the open countryside in conflict with Policies NE.2 (Open Countryside) and NE.16 (The Re-Use and Adaptation of a Rural Building for Residential Use) of the Borough of Crewe and Nantwich Replacement Local Plan 2011.     
 
2          The plans and elevations as submitted provide insufficient information for the Authority to determine the application on the grounds that it is not possible to fully assess the impact of the development on the existing and neighbouring properties, together with the character of the area, in the absence of the necessary details which include the elevations and floor plans of the garage block.  All contrary to Policy BE.2 (Design Standards) of the Borough of Crewe and Nantwich Replacement Local Plan 2011.
 
3          The application does not provide sufficient information for the Authority to determine it on the grounds that it is not possible to fully assess the impact of the proposal on protected species and is contrary to Policy NE.5 (Nature Conservation and Habitats) of the Borough of Crewe and Nantwich Replacement Local Plan 2011 and advice advocated within Circular 06 05.
