49            Councillor Martin declared a personal and prejudicial interest in item 1 (P06/0349) as she had signed a petition against development at the site.  Councillor Butterill declared a personal interest in item 12 (P06/1131) as the applicant was a neighbour.  Councillor Davies declared a personal and prejudicial interest in item 12 (P06/1131) as he and the applicant were members of the same Bowling Club.

1            The Local Planning Authority considers that the applicant has failed to demonstrate that the reasons for the development outweigh the potential adverse impact upon a site of nature conservation value.  In the absence of any agreed Habitable Management Plan, maintaining and servicing the stable is likely to damage this sensitive habitat, contrary to Policy NE.8 (Sites of Local Importance for Nature Conservation) of the Borough of Crewe and Nantwich Replacement Local Plan 2011.    
 
2            The Local Planning Authority considers that the proposed development by reason of its siting which is dislocated from the existing group of buildings and design will be harmful to the visual amenities of the area and as such represents an unacceptable intrusion into this sensitive area of open countryside.  All contrary to Policies BE.1 (Amenity) and NE.2 (Open Countryside) of the Borough of Crewe and Nantwich Replacement Local Plan 2011.

The Local Planning Authority considers the proposed development is unacceptable by reason of its siting and bulk in close proximity to the neighbouring property which will result in over-domination and loss of amenities.  Furthermore, the development will adversely affect the rhythm of the existing street to the detriment of the character and appearance of the area.  All contrary to Policies BE.1 (Amenity), BE.2 (Design Standards) and RES.11 (Improvements and Alterations to Existing Dwellings) of the Borough of Crewe and Nantwich Replacement Local Plan 2011.

REFUSED:     Reason
 
The Local Planning Authority considers the proposed development fails to improve the character and quality of the area.  The design of the dwellings is unacceptable by reason of the height, footprint, layout and detailing of the proposed dwellings which will result in an overly dominant and discordant housing scheme which fails to respect the prevailing character of the area.  To allow the proposed dwellings would thus be contrary to Policy BE.2 (Design Standards) of the Borough of Crewe and Nantwich Replacement Local Plan 2011.

SECTION 106 AGREEMENT:  LAND AT WELSH ROW, NANTWICH FOR PERSIMMON HOMES LTD  
 
52        The Committee considered the joint report of the Executive Directors Legal Services and Environment and Development. 
 
The report sought authorisation from the Committee to vary a Legal Agreement in relation to the provision of affordable housing at Welsh Row, Nantwich.  The effect of the variation would be to increase from 80% to 100% the staircase limit (the ability of the occupier to purchase increasingly larger proportions of the dwelling) in order to meet the Housing Corporations requirements in this instance.                                         
   
RESOLVED:  That a variation of the Legal Agreement outlined in the report be agreed to allow Dane Partnership Homes Ltd and Dane Housing (Congleton) Ltd and their respective successors in title and assigns to permit occupiers of shared ownership units to staircase to 100% at this site, namely land to the rear of Welsh Row, Nantwich and subject to planning permission P04/0260.  The shared ownership units being specifically plots 36, 37, and 39 (three bedroomed houses), plot 38 (two bedroomed house) and plots 54, 55 and 56 (two bedroomed apartments).

53        The Committee was invited to confirm, without modification, a provision Tree Preservation Order (No. 196) made on 18 August 2006 in respect of land off 320 Crewe Road, Crewe as detailed in the report of the Borough Solicitor.  
 
RESOLVED:  That the Land off 320 Crewe Road, Crewe Tree Preservation Order Number 196 made provisionally on 18 August 2006 be confirmed without modification. 
 
TREE PRESERVATION ORDER: TINKERSFIELD/CHERRY TREE COURT, NANTWICH (ORDER NO.202) TPO 2006
 
54        The Committee was invited to confirm, without modification, a provisional Tree Preservation Order (No.202) made on 24 August 2006 in respect of Tinkerfield/Cherry Tree Court, Nantwich as detailed in the report of the Borough Solicitor.
