DECLARATIONS OF INTEREST
 
1          Councillor A Moran declared a personal interest in agenda item No. 10 (Street Naming Development off Gresty Road, Crewe - P-Way Site) on the basis that Mr and Mrs Goode, whose family name was being suggested for inclusion in the Land and Property Gazeteer, were his former employees.
 
No other Member made any declaration of interest in any item of business on the agenda.
 
MINUTES
 
2          RESOLVED:   That the Minutes of the meeting held on 2nd May 2006 be approved as a correct record, subject to the inclusion of Councillor M A Hollins' name in the list of those present.
 
APPLICATIONS UNDER THE TOWN AND COUNTRY PLANNING ACT 1990
 
3          The Borough Planning Officer submitted the following applications for determination.
 
1.            P05/1021       Outline Application for Mixed Use Development comprising Retail (A1), Financial/Professional Services (A2), Cafes, Restaurants, Bars and Hot Food Development (A3, A4, A5), Office Development (B1), Residential (C3) & Multi-Storey Car Park. Relocation of Bus Station, Creation of New Public Open Spaces, Highway Works, Ancillary Servicing Areas and Other Works including Demolition to enable Comprehensive Regeneration, Land contained by Victoria Street to the North, Queensway to the East, Market Square and Phoenix Leisure to the South and Flag Lane to the West for Modus Corovest Ltd
           
RESOLVED:  (a) That the application be referred to Full Council for approval as a departure from the Adopted Replacement Local Plan 2011;
(b) That, subject to Full Council's approval, the Secretary of State be informed that the Borough Council was minded to approve the application subject to the conditions listed below and the completion of a Legal Agreement which secured:
 
(i)         Financial contribution up to a maximum of £800,000 towards public realm improvements within the town centre;
 
(ii)        Financial contribution up to a maximum of £500,000 towards the Flag Lane link road;
 
(iii)       Provision of replacement bus station;
 
(iv)       Financial contribution of £50,000 towards traffic/transportation study for Crewe;
 
(v)        Financial contribution up to a maximum of £350,000 towards the following measures:
 
-                      A town centre car parking/signage strategy;
-                     Improvement of the pedestrian link to the Liberty leisure scheme on Dunwoody Way;
-                      Landscaping of buffer between Tollitt Street houses and bus-station
-                     CCTV study and to link new CCTV facilities within the development site with the existing town centre network
-                      Future maintenance of landscaped areas within the site;
 
(vi)       Provision of satisfactory replacement accommodation for shop mobility within multi-storey car park.

11.       Comprehensive scheme of noise mitigation measures to safeguard amenities of residential properties from the operation of service yards, the use of the multi-storey car park including shielding/wall at rear of Gaffers Row and Gatefield Street and controls on hours of operation    
12.       Submission of a scheme of surface and undercroft car parking for apartments/dwellings off Chester Square
13.       Structural and stability report to include measures to avoid damage to nearby properties during demolition and construction work 
14.       Full details of site levels to be submitted as part of each reserved matters application  
15.       Location and extent of uses within A3, A4 and A5 use classes to be formally defined by reserved matters applications 
16.       No development shall take place until a detailed site investigation to identify any contaminated land and necessary mitigation measures has been submitted and approved by the LPA
17.       No development shall take place within Area 3 of the Chester Square residential scheme until satisfactory replacement parking provision has been approved for users of St Mary's RC Church
18.       Comprehensive Green Travel Plan

1.                  The proposed development is unacceptable by reason that it is considered an overdevelopment of the site and a sub-standard form of development which fails to respect the existing pattern, character and form of the surroundings.  The design of the development is uniform, inappropriate in its context and fails to take the opportunities for improving the character and quality of the area.  As such, the proposal compromises the quality of the local environment.  All contrary to Adopted Replacement Local Plan Policies BE.2 (Design Standards), RES.2 (Unallocated Housing Sites) and RES.3 (Housing Densities).
2.                  The layout of the development is dominated by the car and associated parking provision, all to the detriment of the street-scene and character and appearance of the development.  The proposal is therefore contrary to the requirements of Policies BE.2 (Design Standards) and BE.3 (Access and Parking) of the Adopted Replacement Local Plan.

IMPROVEMENT MEASURES FOR THE DEVELOPMENT CONTROL PROCESS
 
4          The Committee considered the report of the Development Control Manager which proposed a series of modernisation measures to improve the consistency and transparency of the development control process in accordance with a Code of Good Practice. 
 
The issues raised in the report had been discussed at the Modernising Agenda Working Group and in periodic reports to the Development Control Committee.  The report brought together those issues and provided details of best practice and guidance based on the provisions of the Code of Conduct, the Royal Town Planning Institute's Code of Professional Conduct and advice and guidance on planning procedures and protocols issued by the Audit Commission, the Local Government Ombudsman, the National Planning Forum, the Local Government Information Unit and the Local Government Association.
 
RESOLVED: (a) That the Site Inspection Protocol be adopted and implemented as detailed in Appendix 1 of the report;
 
(b) That the Call-in Procedure be adopted and implemented as detailed in Appendix 2 of the report;
 
(c) That the Action Plan, as detailed in the report, be accepted;
 
(d) That the Action Plan be adopted and implemented in accordance with the suggested timescales, including recommendations to Full Council, where necessary, on matters of the Council's Constitution; and
 
(e) That a review be undertaken in 6-months' time.

APPEAL DECISION BRIAR COTTAGE, BICKERTON
 
13        An application for a certificate of lawfulness had been refused by the Committee and an appeal determined by the written representations procedure.  The appeal had been upheld and a certificate issued by the Planning Inspectorate to Sedgemoor Limited in respect of the premises at Briar Cottage, Bickerton. 
 
The report of the Borough Planning Officer was now submitted.  The Assistant Solicitor to the Council addressed the Committee on the outcome of the appeal. 
 
RESOLVED:  That no further action be taken.
