10.       P06/1448       Barn Conversion to Two Dwellings, Rope Green Farm,
Rope Lane, Shavington for R E M & C R Dodd

REFUSED:     Reasons

1          The proposed development is considered unacceptable due to its close proximity to Rope Lane to the west of the site.  No PPG24 (Planning and Noise) noise survey has been submitted as part of this application to identify whether or not noise caused by traffic using Rope Lane would have a detrimental impact upon the amenities of the future occupiers of the future dwellings through noise and disturbance.  In the absence of this information to allow this development would be contrary to PPG24 (Planning and Noise) and Policy BE.1 (Amenity) of the Borough of Crewe and Nantwich Replacement Local Plan 2011.

2          Notwithstanding the submitted application and supporting information, the proposal fails to adequately demonstrate that the buildings are inappropriate for commercial, industrial or recreational use or that every reasonable attempt has been made to secure a suitable business re-use for the buildings.  In particular no attempt has been made to market the buildings for purposes which might benefit the local economy.  To allow the development would be contrary to Policy NE.16 (Re-use and adaptation of a rural building for residential use) of the Borough of Crewe and Nantwich Replacement Local Plan 2011.

11.       P06/1453       Barn Conversion to Six Dwellings, Coronerage Farm,

RESOLVED:  That authority be delegated to the Borough Planning Officer to APPROVE the application subject to the receipt of amended plans and the imposition of relevant conditions.  Should amended plans not be received, the application to be refused on the grounds outlined in the officer's report.

Dwellings, Coronerage Farm, Heatley Lane, Broomhall for P C & S G Thelwell

RESOLVED:  That authority be delegated to the Borough Planning Officer to APPROVE the application subject to the receipt of amended plans and the imposition of relevant conditions.  Should amended plans not be received, the application to be refused on the grounds outlined in the officer's report.

15.       P06/1479       Outline Application for 6 Dwellings, Disused Church
Meeting Hall, Stafford Street, Crewe for Mr M Jevon

REFUSED:     Reasons

1          The Local Planning Authority considers that the proposed development is unacceptable by reason of the general layout, siting and scale of development proposed.  The site is of insufficient size to accommodate six terraced houses together with parking and private open space in a manner which respects the character of the locality and the proposal is therefore considered to represent over development of the site.  The parking to the front of the dwellings results in a car dominated development allowing no space for landscaping.  Furthermore, the proposal fails to take the full opportunities to improve the appearance of the street scene and create continuity of development in sympathy with its surroundings.  To allow the development would be contrary to Policies RES.2 (Unallocated Housing Sites), RES.3 (Housing Densities) and BE.2 (Design Standards) of the Borough of Crewe and Nantwich Replacement Local Plan 2011 and PPS1: Delivering Sustainable Development.

2          The siting and scale of the proposed dwellings will result in unreasonable overlooking and domination of the adjacent dwellings in Adelaide Street to the detriment of residential amenities at those and the proposed dwellings.  To allow the development would be contrary to Policy BE.1 (Amenity) of the Borough of Crewe and Nantwich Replacement Local Plan 2011.

16.       P06/1482       Erection of 8 No. Apartments, 48-54 Davenport Avenue,
Nantwich for D A & C A Tomlinson Properties

DEFERRED:    Reason

For negotiation on level of parking provision and design.

17.       P07/0001       Barn Conversion to Five Holiday Accommodation Units,
Chapel Farm, Audlem Road, Hatherton for Mr J Roach

REFUSED:     Reasons

1          The proposed development is considered unacceptable by reason of unsatisfactory access arrangements.  There is a lack of evidence to demonstrate that the applicant can secure a safe vehicular access to the development or that the additional traffic movements would be offset by reductions in agricultural vehicles.  The proposal therefore conflicts with Policy BE.3 (Access and Parking) of the Borough of Crewe and Nantwich Replacement Local Plan 2011.

2          The proposed development is considered unacceptable by reason of its potential impact upon protected species.  There is a lack of evidence to demonstrate that the proposed development will not adversely affect the habitats of any protected bat or barn owls.  The proposals is therefore considered to conflict with Policies NE.9 (Protected Species) as well as Government guidance within Circular 06/2005 (Biodiversity and Geological Conservation Statutory Obligations and their impact within the planning system).

18.       P07/0017       Outline Application for the Erection of Five Office

RESOLVED:  That authority be delegated to the Borough Planning Officer to APPROVE the application subject to negotiations over the flood risk assessment and the following conditions -

5          All reserved matters applications to include framework travel plan

13        Great Crested Newt mitigation measures
14        Bat mitigation measures
15        Bird mitigation measures
16        Badger mitigation measures
17        Buffer to the Englesea brook

19.       P07/0026       Single Storey Side Extension (Re-submission), 33b
Marsh Lane, Nantwich for Mr & Mrs I Hesp

REFUSED:     Reason

The Local Planning Authority considers that the proposed development is unacceptable by reason of its siting and the unjustified removal of two trees and the potential adverse impact and damage to a third which are prominent in the street scene and are all protected by a group Tree Preservation Order.  The removal of these trees for the provision of the extension would be detrimental to the street scene in the locality and contrary to Policy BE.1 (Amenity), RES.11 (Improvements and Alterations to Existing Dwellings), NE.5 (Nature Conservation and Habitats) of the Borough of Crewe and Nantwich Replacement Local Plan 2011.
