Notes for Members of the Public

 

The Development Control Committee consists of 16 elected Members and Councillor Margaret Hollins is the Chair.  There are 8 Conservative, 5 Labour, 1 Liberal Democrat, 1 Nantwich Independent and 1 Independent Member.   

The Borough Council welcomes and encourages members of the public to attend its Committee, Board and Council meetings.

If you plan to attend, please report to the Reception Desk in the Municipal Buildings, where you will be provided with a Visitor’s Pass.

Car parking is not available at the Municipal Buildings, but there are several town centre car parks. There is a disabled access to the rear of the Municipal Buildings, and this can be accessed through the side door on Vernon Way. Please press the button for attention, and someone will meet you and escort you through to the main reception area.

You are asked to remain quiet whilst the meeting is taking place, and to enter and leave the meeting room, or public gallery of the Council Chamber as quietly as possible. If you should leave the meeting before it has concluded please exit through the Council Chamber, not via the rear stairs. Please ensure that if you have a mobile phone or pager, it is switched off for the duration of the meeting.

You are not allowed to have drinks or food in the meeting rooms, nor in the Public Gallery. 

 

 

Fire Evacuation

If the fire alarm rings, you should make your way to the nearest exit with your belongings, as quickly as possible, and leave the building.  Please follow any instructions from staff about evacuation routes.

Copies of the agenda will be available if you attend. Agendas are also made available on the Internet and can be accessed via the Council’s website – see front page for details.

On occasions, members of the press and public will be excluded from the meetings when the business to be transacted is of a confidential nature, for example, dealing with individual people, contracts and financial affairs of other parties.

1.       Declarations of Interest

 

Any Member present (including non-Committee Members) to declare any personal or prejudicial interests and the nature of that interest, in any item of business on the agenda and, if necessary, to leave the meeting prior to discussion of that item.  

Members who also serve as County, Town or Parish Councillors are reminded of the need to make declarations in respect of any item which directly concerns the business of the appropriate authority. 

Declarations are a personal matter for each Member to decide.  Whilst officers will advise on the Code of Conduct and its interpretation, the decision to declare, or not, is the responsibility of the Member, based on the particular circumstances.

4.                  Tree Preservation Order: Land South of The Beeches, Audlem Road, Hatherton (Order No. 211) TPO 2007 

 

The Committee is invited to confirm without modification, provisional Tree Preservation Order No. 211 made on 5 September 2007 in respect of land south of The Beeches, Audlem Road, Hatherton (4).    


5.                  Tree Preservation Order: Land to the Rear of 2 Rowton Road, Crewe (Order No. 212) TPO 2007

 

The Committee is invited to confirm without modification, provisional Tree Preservation Order No. 212 made on 5 September 2007 in respect of land to the rear of 2 Rowton Road, Crewe (5).     

 


6.                  Tree Preservation Order: Land Adjacent to 47 Audlem Road, Nantwich (Order No.214) TPO 2007 

 

The Committee is invited to confirm without modification, provisional Tree Preservation Order No. 214 made on 23 October 2007 in respect of land adjacent to 47 Audlem Road, Nantwich (6).   


 

7.                  Tree Preservation Order: 58 South Crofts, Nantwich (Order No.216) TPO 2007

 

The Committee is invited to confirm without modification, provisional Tree Preservation Order No. 216 made on 23 November 2007 in respect of 58 South Crofts, Nantwich (7).    


8.                  Application For The Diversion Of Parts Of Footpaths At Stafford Street, Crewe in the Borough Of Crewe And Nantwich 

 

An application has been received by the Borough Council to divert parts of a number of footpaths in the vicinity of Stafford Street, Crewe to enable development to be carried out in that area by Wulvern Housing Limited. 

The Committee is invited to approve the application (8).     


9.                  Street Naming: Eddivane Court, Haslington (Land off Cross Street and to Rear of 60 Crewe Road Haslington)

The Committee was invited, at its December meeting, to approve a suitable name for the development situated at Land off Cross Street and to Rear of 60 Crewe Road Haslington. At that time the name proposed “Fox Hollow” was rejected as being too similar to other street names within the Borough and the matter was deferred to allow alternative proposals to be brought forward.

The report of the Borough Planning Officer (9) suggests the name ‘Eddivane Court’ after a former parish Councillor.  The Committee is invited to approve the name for the development.

12.             Exclusion of Press and Public

 

The report relating to the remaining item of business on the agenda has been withheld from public circulation and deposit pursuant to Section 100(B)(2) of the Local Government Act 1972 on the grounds that the matters may be determined with the press and public excluded.

The Committee is invited to RESOLVE that the press and public be excluded from the meeting during consideration of the following matter pursuant to Section 100(A)(4) of the Local Government Act 1972 on the grounds that it involves the likely disclosure of exempt information as defined in paragraph 3 of Part 1 of Schedule 12A (as amended) of the Act.

 

(Note: Paragraph 3 relates to information relating to the financial or business affairs of any particular person (including the authority holding that information.)  


13.       Request for Delegated Authority to Institute Proceedings for Failure to Comply with Terms of a Planning Obligation    

 

The Committee is invited to consider the report of the Borough Solicitor (13)  which seeks authority to institute legal proceedings against a property developer for failure to comply with the terms of a planning obligation entered into as part of a planning permission granted in 2006. 


 

Note:

 

In accordance with the Health and Safety at Work Act the Council is required to notify those attending meetings of the fire evacuation procedures.  A copy has previously been circulated to Members and instructions are located in all rooms within the Civic Suite.
