Notes to Members of the Public

The full Licensing and Regulatory Committee consists of 15 elected Members.  Councillor Stan Davies is the Chair.  This Committee has 7 Sub-Committees.  There are 2 x 8-Member Sub-Committees which deal with Hackney Carriage and Private Hire licensing and personnel matters and there are 5 x 3-Member Sub-Committees which deal with matters under the Licensing Act 2003.

The Borough Council welcomes and encourages members of the public to attend its Committee, Board and Council meetings.

If you plan to attend, please report to the Reception Desk in the Municipal Buildings, where you will be provided with a Visitor’s Pass.

Car parking is not available at the Municipal Buildings, but there are several town centre car parks.  There is a disabled access to the rear of the Municipal Buildings, and this can be accessed through the side door on Vernon Way.  Please press the button for attention, and someone will meet you and escort you through to the main reception area.

You are asked to remain quiet whilst the meeting is taking place, and to enter and leave the meeting room, or public gallery of the Council Chamber, as quietly as possible.  Please ensure that if you have a mobile phone or pager, it is switched off for the duration of the meeting.

You are not allowed to have drinks or food in the meeting rooms, nor in the Public Gallery.  A “No Smoking” policy operates in the Municipal Buildings.

 

Fire Evacuation

If the fire alarm rings, you should make your way to the nearest exit with your belongings, as quickly as possible, and leave the building.  Please follow any instructions from staff about evacuation routes.        

Copies of the agenda will be available if you attend. Agendas are also made available on the Internet and can be accessed via the Council’s website – see front page for details.

On occasions, members of the press and public will be excluded from the meetings when the business to be transacted is of a confidential nature, for example, dealing with individual people, contracts and financial affairs of other parties.

AGENDA

1          Declaration of Interests

Any Member present (including non-Sub-Committee Members) to declare any personal or prejudicial interest, and the nature of the interest, which they have in any item of business on the agenda and, if necessary, to leave the meeting prior to discussion of that item.

Members who also serve as County, Town or Parish Councillors are reminded of the need to make declarations in respect of any item which directly concerns the business of the appropriate authority.

Declarations are a personal matter for each Member to decide.  Whilst Officers will advise on the Code of Conduct and its interpretation, the decision to declare, or not, is the responsibility of the Member, based on the particular circumstances.


2          Minutes of the Meeting held on 29th August 2006

To approve as a correct record the Minutes of the previous Sub-Committee No. 7 meeting held on 29th August 2006. (2)


3          Mr. Maydew - Licence to Drive Hackney Carriage and Private Hire Vehicles

The report of the Executive Director of Environment and Development (3) gives details of an existing driver of Hackney Carriage and Private Hire vehicles.  The driver has a conviction which will not become spent until June 2011.

The licence-holder failed to attend two previous Sub-Committee meetings.  At the second of those meetings (26th September 2006), Members of Sub-Committee No. 6 were not satisfied with the reasons given for the licence-holder’s failure to attend and suspended his licences pending his appearance before a Sub-Committee meeting.

The Sub-Committee is asked to determine whether the licence-holder is a “fit and proper” person to continue to hold the licences.

A copy of the Council’s “Statement of Policy About Relevant Convictions” is enclosed, together with a copy of the procedure to be followed at the meeting.  

Note:  These two documents are also relevant to agenda items 4 and 5.


4          Mr. Stanley - Licence to Drive Hackney Carriage and Private Hire Vehicles

The report of the Executive Director (Environment and Development) (4) gives details of the holder of a licence to drive Hackney Carriage and Private Hire vehicles, who now has a conviction for a drink-driving offence which will not become spent until 18th November 2010.

The Sub-Committee is asked to determine whether the licence-holder is a “fit and proper” person to continue to hold the licence.

Members are asked to refer to the Council’s “Statement of Policy about Relevant Convictions” and the procedure to be followed at the meeting which are attached as part of agenda item No. 3 above.


5          Mr. Lockett - Licence to Drive Hackney Carriage and Private Hire Vehicles

The report of the Executive Director (Environment and Development) (report to follow) gives details of a new applicant who has revealed that he has a conviction for driving with excess alcohol.  The conviction will not become spent until 19th October 2009.  

The Sub-Committee is asked to determine whether the applicant is a “fit and proper” person to hold a licence.

Members are asked to refer to the Council’s “Statement of Policy about Relevant Convictions” and the procedure to be followed at the meeting which are attached as part of agenda item No. 3 above.


6         Licence Fees for 2007/2008

The report of the Executive Director (Environment and Development) (6) proposes an increase in fees for certain of the licences which fall within the jurisdiction of the Licensing and Regulatory Committee.

The Sub-Committee is invited to RESOLVE –

(1)   That notice be given of the proposed increase in licence fees for Hackney Carriage and Private Hire vehicle and operator licences shown in Table A of the report and that, subject to there being no objections received, the revised fees be brought into effect from 1st April 2007; and

(2)   That licence fees for Hackney Carriage and Private Hire drivers, sex   establishments and motor vehicle salvage operators be increased as shown in Table B and be brought into effect from 1st April 2007.

Note:

In accordance with the Health and Safety at Work Act, the Council is required to notify those attending meetings of the fire evacuation procedures.  A copy has previously been distributed to Members and instructions are located in all rooms within the Civic Suite.
