Reporting Abandoned Vehicles

Crewe and Nantwich Borough Council aim to investigate each report of an abandoned vehicle within 24 hours of notification.

Last year 2005/2006, the council investigated 355 reports of abandoned vehicles. A percentage of these were eventually removed at the expense of the council and subsequently scrapped.

What is an abandoned vehicle?
An abandoned vehicle is usually a vehicle that has been left in one location for several weeks, showing signs of vandalism/deterioration and/or having no valid tax disc. However, this isn't always the case, with some vehicles being in a reasonable condition, with a current tax disc on show.

The Refuse Disposal (Amenity) Act 1978 states that 'where it appears to a local authority that a vehicle has been abandoned, without lawful authority, on any land in open air or on any land forming part of a highway, it shall be the duty of the local authority to remove the vehicle'.

There is a legal procedure, which Crewe and Nantwich Borough Council must follow when dealing with abandoned vehicles.

Untaxed vehicles.
Some local authorities have signed up with the DVLA to adopt devolved powers. This enables them to tackle untaxed vehicles that haven't been abandoned. The council are looking into the possibility of joining such a scheme in the near future. This would probably be a joint agreement with the other local authorities in Cheshire.
