RADICAL NEW PLANNING RULES
FOR HOME IMPROVEMENTS
From the 1st October 2008, new planning regulations
will come into force, which mean that many extensions which have
previously required planning permission can now be constructed
without the need to apply to the Local Authority. However, some
proposals which were previously “permitted development” will now
require planning permission, including, for example, all
conservatories or rear extensions over 3m in length.
As well as new size limits for extensions and roof alterations,
the new regulations prevent householders from installing driveways,
parking areas and hard standings of more than 5 square metres in
area, in their front gardens, without planning permission, unless
they have permeable surfaces. New controls have also been
introduced for balconies, verandas and decking.
The Planning Portal provides information relating to the need
for planning permission on their web page at http://www.planningportal.gov.uk/.
However, home owners should be aware that the Planning Portal is
unable to give specific advice relating to individual properties.
For example, it does not contain information on whether or not a
property is Listed, located within a Conservation Area or subject
to restrictive conditions attached to previous planning
permissions.
Therefore, householders who are considering undertaking works to
their properties are advised to use the Council’s Permitted
Development Enquiry Service which will provide written confirmation
of whether or not planning permission is required, which is often
required by purchaser’s solicitors. The current fee for this
service is £35 and an application form can be downloaded here.
Validation
checklists
The Borough Council had adopted Local Validation Checklists
for planning applications. Local
Validation Checklists will be used in association with
national requirements to assess whether a planning application is
valid, i.e. all the necessary information relating to the type
of development proposed has been submitted, thus enabling the
Local Planning Authority to make an informed
decision.

Planning Explorer is a searchable
database of planning applications lodged with the
Council. This information is updated daily.
This service works best with Internet Explorer.
If you have another browser you may not be able to access
drawings.
Ensure there are no add ons
or toolbars installed within Internet Explorer.
Ensure that any pop up blockers are switched off.
Ensure that Adobe Acrobat Reader is installed.
Planning Explorer opens with
a general search screen. If you know the application
number use the links on the right hand side of the
screen.
The service provides
information on application number, site
address, description of development, decision and
decision date for each application. Related drawings
and documents including site plans, elevational
drawings and decision notices can be accessed by clicking
on the application number. These documents
are available in digital format and can be
downloaded and viewed. "Right click" on View Related
Documents and open in a new window to see the list.
This makes it easier to go back to the search in the original
window.

Users can track/monitor the progress
of an application from its registration to determination, including
the date an application was received,
the validation date, the dates of public
consultation and the date of decision and notice
production.
If your security settings on
your web browser are set to block pop-ups you may get an
information message. To continue and view the document click
on OK and click on the message bar at the top of the
screen. Choose to "Temporarily allow pop-ups", click on Retry
and the document should load to view. You should
also enable pop ups on any toolbars that may be installed, for
example Google, MSN, Yahoo etc.

available between 22:00 p.m. and 23.00 p.m.

The Planning Inspectorate
The main work of the the Planning
Inspectorate is the processing of planning and enforcement appeals
and holding inquiries into local development plans. They also
deal with a wide variety of other planning related casework
including listed building consent appeals, advertisement appeals,
and reporting on planning
applications.
