Unauthorised Building Works carried out on or
after 11th November 1985
Unauthorised Building work means building
work other than work in relation to an initial notice, an amendment
notice or a public bodies notice has effect, which is done without
:-
- a building notice being given to the Local Authority; or
- full plans of the work being deposited with the Local
Auhtority; or
- a notice of commencement of work being given, in accordance
with Regulation 15(1) of the Building Regulations, where a building
notice has been given or full plans have been deposited.
If this situation has arisen the owner may apply in writing to
the Local Authority for a Regularisation Certificate. Such
an application should include;
- a statement that the application is made in accordance with
Regulation 21 of the Building Regulations.
- a description of the unauthorised work.
so far as is reasonably practicable,
- a plan of the unauthorised work.
A Regularisation Certificate is evidence (but not conclusive
evidence) that the relevant requirements specified in the
certificates have been complied with.
