Developer prosecuted for removing a tree at former Police

Crewe and Nantwich Borough Council has
recently taken action against a property developer for felling a
tree that was subject to a Tree Preservation Order. The
unlawful act of cutting down a hawthorn tree at the site of the
former Police Training College off Nantwich Road resulted in a
hefty fine.
On the 7th September 2007, Morris
Homes (West Midlands) Ltd removed a hawthorn tree protected by a
tree preservation order. Following complaints from local
residents, the Borough Council’s Planning Enforcement team launched
an investigation. As a result of their enquiries, the Council
issued criminal proceedings. On 2nd April 2008,
the developer pleaded guilty at Crewe Magistrates Court and was
fined £1500 plus costs. The developer has also planted a
replacement tree.
David Snelson, one of the Borough’s Principal
Planning Officers, said: “Protected trees make a valuable
contribution to the visual amenity of the area and it is important
that prior to undertaking any works to TPO trees that specialist
advice is sought from the Council. As is reflected in the
level of fine imposed by the Courts, the consequences of
unauthorised works are very serious.”
