Crewe and Nantwich Retail
Markets - Rules and Regulations - Revised April 2002
Section 1:
General Rules and Regulations Applicable to all
Sections of the Market i.e. Market Halls, Outside - Covered and
Uncovered Markets and storage areas
1.1 A main Market will be held
- a) At Crewe: on each Friday, Saturday and Monday throughout the
year.
The public opening time for the outside Market area shall be 8.30am
to 5.30pm on Fridays and Saturdays and 8.30am to 1.30pm on Mondays.
The Market Hall shall be open all week from 8.30am to 5.30pm
Monday, Tuesday, Thursday, Friday and Saturday, with half day
closing at 1.30pm on Wednesdays.
- b) At Nantwich: on each Thursday, Saturday and Tuesday
throughout the year.
The public opening time for the outside Market area shall be 8.30am
to 5.30pm on Thursdays and Saturdays and 8.30am to 1.30pm on
Tuesdays.
1.2 Should a market not be held on any
established market days, at least two weeks' notice will be given
by means of Bills, prominently displayed in and around the relevant
Market.
1.3 All Market Traders must agree to stand
for at least the Market core opening hours. These must be observed
by all Market traders, and shall be
- a) At Crewe:
Fridays 9.30am - 4.30pm
Saturdays 9.30am - 4.30pm
Mondays 9.30am - 1.00pm
- b) At Nantwich:
Thursdays: 9.30am - 3pm
Saturdays: 9.30.am - 4.30pm
Tuesdays: - 9.30am - 1.00pm
Section 2:
Market Trader Categories and Conditions
2.1 There are two categories of permanent
trading placements on the Market:
- Licensed - Applicable to permanent lock-up units only.
- Registered - Applicable to all permanent outside covered and
uncovered stalls and pitches.
2.2 In addition, casual traders may be
allocated stalls or pitches on a day to day basis (subject to
availability).
2.3 Registered stallholders will have the
stall or space allocated to them for the specified Market day,
reserved for them by agreeing to pay the rent one week in advance.
The rent is payable whether they attend or not, except when the
stall is let in their absence to some other person.
2.4 Rent for registered traders outside will
be calculated to allow a pre-arranged absence for the market for
two weeks annually. This is done by dividing the total rent due for
the year by 52 and multiplying by 50. Traders qualify for this rent
by trading in the market for at least three months.
2.5 Registered stalls or spaces will not be
let to any person selling similar goods to those sold by the
registered stallholder.
2.6 Licensed and registered stallholders are
not permitted to sub-let or assign any portion of their stall or
space, under any circumstances.
2.7 All stalls or spaces not occupied by the
registered stallholder by 9.00am will be re-let unless the
permission of the Market Manager to arrive at a later hour has been
previously obtained.
2.8 Any stall or space not occupied for one
week (and not occupied by 9am on the second week), will be
considered to be vacated unless the stallholder has sent a
satisfactory reason for absence to the Market Manager and paid any
rent due as a consequence of his absence.
2.9 Licensed and registered stallholders
shall not sell any type of foods other than those for which they
are registered.
2.10 No radios or tape recorders are to be
played at any time. The use of voice amplification systems (PA
units etc), are not permitted unless permission for such use has
been previously obtained, under special licence, from the Market
Manager.
Section 3:
Access to the Market for Vehicles
These rules relate to the designated areas of
- The outside market area, the Lyceum Square area and all of
Heath Street and Hill Street in Crewe
- The outside market area, market frontage (Churchyardside) and
market rear area (off Market Street), in Nantwich.
3.1 No trader shall bring into the designated
market area or adjacent access roads any cart or vehicle, except
for the purpose of it being immediately loaded or unloaded.
The designated areas are:
- The outside market area
- The Lyceum Square area
- All of Heath Street and Hill Street
Exceptions to this rule will only be made by prior agreement
with the Market Manager, in the following circumstances:
i) Where it is agreed that the trader may
trade from his vehicle on a pitch where the vehicle can be
satisfactorily incorporated into the trader's agreed pitch area.
For this to be agreed the manager must be satisfied that the
vehicle's presence will not cause obstruction to customer movement
or sight lines through the market; and
ii) That health and safety considerations are
not violated.
3.2 NO MOVEMENT OF MARKET TRADERS CARTS OR VEHICLES IS
PERMITTED ON MAIN MARKET DAYS DURING THE MARKET 'CORE' OPERATING
TIMES (see 1.3 above).
Section 4:
General - Management
4.1 The Market Manager is empowered to
temporarily alter or vary in these Rules and Regulations in any
way, should it be found desirable in the general interest of the
Market to do so.
4.2 Shoppers Charter: Crewe and Nantwich
Markets operate a Shoppers Charter recognised by the National
Market Traders Federation. All traders must abide by its
terms.
4.3 Traders must abide by the terms of
the Refund Policy. Where a customer's claim is disputed by the
trader, the Market Manager will make a judgement. If the customer
is judged by the Manager to have justifiable grounds for this
refund, any trader who still refuses to refund will be fined one
weeks' rent or the value of the refund, or may face expulsion from
the market. The trader will be informed of this in writing and a
record kept by the Market Manager.
4.4 Smoking is not allowed in the Market
Halls in both towns. Traders or their staff who smoke in the Halls
may be expelled from the Market.
4.2 Insurance
All Market traders wishing to trade from Crewe or Nantwich
Markets must be in possession of a current certificate of public
liability insurance. The insurance must clearly indemnify the
Borough Council from any third party claims arising from any
negligence resultant from the trader's business operation on the
market. The insurance certificate must be produced for the annual
inspection of the Market Manager in respect of licensed and
registered Crewe or Nantwich Market Traders. Casual traders must be
in possession of a current insurance certificate available for
inspection on first attending the market, and thereafter on demand
by the Market manager.
4.5 A copy of these Rules and
Regulations shall be given to each new applicant for the hire of a
stall or space and such applicant shall duly sign the application
form and agree to abide by the above condition.
